Terms of Use

These terms apply when you use Habit Aquarium, an app made by Lone Astronaut Studios, the trading name of Facundo Iraola Dopazo ("we"). By using the app you agree to them. They are short, and we have tried to write them plainly.

The licence

If you got the app from the App Store, Apple's Licensed Application End User License Agreement is the licence under which you use it. These terms add to it what is particular to our app. Where the two disagree, Apple's agreement wins.

Apple is not responsible for the app, its content or its support. Questions and claims about the app come to us.

The app

Habit Aquarium is a habit tracker: each habit is a fish, and keeping the habit feeds it. It works fully on your phone without an account. It is not medical or psychological advice; if you are trying to quit something that affects your health, a professional can help in ways an app can't.

Free and Premium

The app is free to download and use. The free plan includes one tank, three habits, the common fish and one tank look, with every reminder and both widgets.

Premium is an optional subscription. It adds unlimited tanks and habits, the rare fish, every tank look and the new fish we add over time. What Premium includes may grow and change. We don't promise a particular fish on a particular date.

Subscriptions

• Plans. Premium is offered monthly or yearly. In the United States the prices are $3.99 a month and $19.99 a year. Prices differ by country and region, and the App Store shows you the price in your currency before you buy.
• Free trial. The yearly plan starts with a 7-day free trial if you haven't had one before. If you don't cancel at least 24 hours before the trial ends, the first year is charged when it ends. If you buy a subscription during a trial, the rest of the trial ends.
• Payment. Payment is charged to your Apple Account when you confirm the purchase, or when the free trial ends.
• Renewal. A subscription renews automatically for the same period unless you cancel it at least 24 hours before the current period ends. The renewal is charged within the 24 hours before the period ends, at the price you agreed to. If the price changes, Apple tells you first, and asks for your agreement where the law requires it.
• Cancelling. You can cancel at any time in your iPhone's settings: tap your name, then Subscriptions. Apple explains how in Cancel a subscription from Apple. Premium then lasts until the end of the period you paid for. Deleting the app or your account doesn't cancel a subscription.
• Refunds. Refunds are handled by Apple, under Apple's rules: request a refund from Apple.
• Restoring. A subscription belongs to the Apple Account that bought it. On a new phone, Restore Purchases brings it back.
• When Premium ends, what you already made stays: your tanks, fish and habits keep living. You can't add more than the free plan allows until you subscribe again.

Your account

An account is optional. If you make one, you are responsible for the email address or the Apple or Google account you sign in with. One account works in every app of ours, with each app's data kept apart. You can delete your account at any time, in the app.

What you create

Your habits, fish, tanks and their history are yours. If you sign in, you allow us to store and copy them for the one purpose of backing them up and keeping your phones in step. Our Privacy Policy says how.

Fair use

Please don't misuse the app or its backend: don't try to reach other people's data, to get around the limits of the free plan or of Premium, to disrupt the service, or to copy the app's art to sell it. We may suspend an account that does.

The service as it is

We work to keep the app and its backup running and correct, but we provide them as they are, and we can't promise they will always be available or free of mistakes. Your data always stays on your phone, and you can export it at any time. If we ever stop the backup service, we will tell you beforehand, so that nothing is lost.

Apple's agreement limits our liability as far as the law allows. Nothing in these terms limits a right you have as a consumer that the law of your country doesn't let a contract take away.

Changes to these terms

When we change these terms, we publish the new version here with a new date. If a change matters to you, we will tell you before it applies.

Law

These terms are governed by the laws of the Eastern Republic of Uruguay. If you live in the European Union or another country whose consumer law protects you more, that protection still applies, and you can bring a claim in your own country's courts.
